Here’s how it breaks down:

Each step must be completed successfully to reach registration.

Before the Publication Period: What Happens First?

You don’t reach the trademark publication period immediately. The process starts with filing—and a long wait.

Initial USPTO Review

After you file, the USPTO assigns your application to an Examining Attorney. This review typically happens 6 to 8 months after your filing date.

The examiner checks:

  • If your mark is distinctive
  • If it’s too similar to existing trademarks

  • Claims that your mark is deceptive or improperly filed
  • Belief that your mark negatively affects the trade or reputation of another.

An opposition leads to litigation before the Trademark Trial and Appeal Board (TTAB).
